McCutchen Firearms, LLC (“McCutchen”) guarantees to the original purchaser of a new firearm from McCutchen that such firearm will be free from defects in material and workmanship for the duration of time that the original purchaser owns the firearm.
In order to initiate a claim under this guarantee, the purchaser must contact McCutchen Customer Service in writing at email@example.com or by phone at (844) 635-0669, of the defect, and provide the model and serial number of the firearm, date purchased, and a description of the problem. McCutchen will provide the purchaser with instructions on returning the firearm. McCutchen will either, at its sole discretion, repair or replace the firearm with the same or comparable model. If McCutchen decides to replace the firearm, McCutchen will keep the firearm that it replaces.
This guarantee does not cover personal injury, loss or damage to the firearm due to: failure to provide proper care and maintenance; accidental discharge; negligent handling or misuse; abuse or misuse; barrel obstruction; custom, hand loaded, reloaded, improper or defective ammunition; unauthorized adjustments, parts replacement, alterations, or repairs; or, normal wear and tear.
In no event will McCutchen be responsible for incidental or consequential damages under this guarantee. Incidental or consequential damage means any loss, expense, or other damage that cannot be remedied by either repairing or replacing the firearm. The implied warranties of merchantability and fitness for a particular purpose are expressly disclaimed. Some states do not allow exclusions or limitations on warranties or guarantees, so the above limitations may not apply to you.
The full liability of McCutchen under this guarantee shall be limited solely to the obligation to repair or replace the firearm and to pay transportation and insurance charges for return of the firearm to its original owner. McCutchen will not provide cash, credit, or refund.
